1. Acceptance of These Terms
These Terms of Use govern access to and use of CreativeTrail High School mode.
By using CreativeTrail, you agree to these Terms. If you are using CreativeTrail on behalf of a school, district, class, or educational program, you represent that you are authorized to do so.
Students may use CreativeTrail High School mode only through a school-authorized class, teacher, district, or educational program.
2. Educational Purpose
CreativeTrail is an educational writing-process platform. It is designed to help students and teachers document planning, drafting, revision, source engagement, reflection, and writing-process evidence.
CreativeTrail is not an AI detector and must not be used as the sole basis for grading, discipline, or academic-integrity decisions.
Teachers and schools are responsible for interpreting CreativeTrail outputs and making educational decisions.
3. High School Eligibility
High School mode is intended only for students who are at least 13 years old.
Students under 13 may not use CreativeTrail unless CreativeTrail has implemented an approved consent process and the required school or parent/guardian authorization is in place.
Teachers and schools are responsible for ensuring that High School students are eligible to use the platform.
4. Accounts and Access
Teachers may create or access accounts using supported authentication methods.
High School students may access CreativeTrail through a class code, pseudonymous student code, PIN, or other school-authorized access method. High School students must not share their PIN, student code, or access credentials with others.
Teachers are responsible for managing class access, assignment setup, and student participation.
CreativeTrail may suspend or restrict access if it reasonably believes an account or class is being misused, compromised, or used in violation of these Terms.
5. Roster Encryption and Student Names
CreativeTrail High School mode stores student names in encrypted form. Teachers may unlock roster names locally using a roster passphrase.
Teachers are responsible for protecting the roster passphrase. If the roster passphrase is lost, CreativeTrail may not be able to recover encrypted student names.
CreativeTrail may still store student-linked writing, source work, reports, prompt responses, and process evidence connected to pseudonymous student codes and class records.
6. Student Content
Students and teachers may submit, upload, or create content in CreativeTrail, including writing, source work, annotations, reflections, assignment prompts, feedback, and related classroom materials.
As between CreativeTrail and the school/student, the school or student retains ownership of student-created content. CreativeTrail does not claim ownership of student writing.
By using CreativeTrail, the school, teacher, and student authorize CreativeTrail to process student content as necessary to provide the service, including storing drafts, revisions, source work, prompt responses, reports, and process evidence.
7. AI Features
CreativeTrail may use AI features to support Socratic prompting, process-evidence analysis, feedback, scoring, categorization, report generation, or related educational functions.
AI outputs may be incomplete, inaccurate, or inappropriate for a particular student or assignment. Teachers should review AI-supported outputs before relying on them.
CreativeTrail does not provide legal, academic-integrity, disciplinary, or grading decisions. CreativeTrail outputs should be used as evidence and support, not as final determinations.
8. Acceptable Use
Users may not:
- Use CreativeTrail for unlawful purposes
- Attempt to access another student's or teacher's account
- Share access credentials with unauthorized users
- Bypass authentication, enrollment, or class access controls
- Upload malware or harmful code
- Interfere with platform security or operation
- Scrape, reverse engineer, or abuse the service
- Use CreativeTrail to harass, threaten, or harm others
- Enter real student data into demo or presentation pages not intended for student use
- Use CreativeTrail outputs as the sole basis for punishment, discipline, or academic-integrity accusations
9. Teacher and School Responsibilities
Teachers and schools are responsible for:
- Using CreativeTrail for legitimate educational purposes
- Providing any notices or obtaining any permissions required by school policy or applicable law
- Ensuring students are at least 13 years old unless an approved consent process exists
- Protecting class codes, roster passphrases, and teacher account credentials
- Reviewing CreativeTrail outputs before using them in classroom decisions
- Responding to parent/student access or deletion requests where the school controls the education record
- Not uploading unnecessary sensitive information
10. Privacy
CreativeTrail's collection and use of information is described in the CreativeTrail High School Privacy Policy and any applicable school agreement or student data addendum.
By using CreativeTrail, you agree that CreativeTrail may process information as described in those documents.
11. Service Availability and Changes
CreativeTrail is an early-stage product and may change over time. Features may be added, modified, limited, or removed.
CreativeTrail will make reasonable efforts to maintain reliable service, but does not guarantee uninterrupted availability.
For school pilots, CreativeTrail may provide additional support, bug fixes, and product updates as agreed with the school or teacher.
12. Security
CreativeTrail uses reasonable technical and organizational safeguards designed to protect information. However, no online service can be guaranteed completely secure.
Users must promptly notify CreativeTrail if they believe an account, class code, PIN, roster passphrase, or other access credential has been compromised.
13. Deletion and Suspension
CreativeTrail may delete, deidentify, archive, or restrict access to data in accordance with its Privacy Policy, retention practices, school requests, legal obligations, or security needs.
CreativeTrail may suspend or terminate access for violations of these Terms.
14. Disclaimers
CreativeTrail is provided “as is” and “as available” during pilot and early-access use.
To the maximum extent permitted by law, CreativeTrail disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
CreativeTrail does not guarantee that process scores, AI outputs, reports, or flags will be accurate, complete, or appropriate for every classroom use.
15. Limitation of Liability
To the maximum extent permitted by law, Benton Growth Labs LLC and CreativeTrail will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
For school pilots or written school agreements, any liability terms in the signed agreement will control if they conflict with this section.
16. Changes to These Terms
CreativeTrail may update these Terms. For school deployments, CreativeTrail will provide notice of material changes to the school, teacher, or other authorized contact.
